The principles of data protection prevailing in recent times have existed in the national and EU legal system for decades, but they have received enhanced attention from the employers since the adoption of the GDPR. This—on the one hand—is due to the fines, and—on the other hand—because of the efforts made to achieve a more conscious data management. Opus Simplex had dealt with data processing by employers long before the entry into force of the EU data protection regulation, not only on a practical, but also on a professional-academic basis; our colleagues have been authors of many publications and given public lectures on this topic over the last decade.
In the area of data protection we deal with the professional rules relating to a variety of sectors (processing industry, health care, financial sector), but our principal area is data processing by employers. We have in-depth knowledge of the rules relating to employment relationships in the private sector and the practical solutions applied therein, the labour law and payroll processes, as well as the taxation, social security and alien policing rules relating to them. On this basis, we are able to understand and shed a light on the employer’s data processing practice from several aspects, help the description and development thereof, and to assess its effects and background rules in case of new data processing plans relating to employment.
Within the framework of our services we are able to provide efficient support for the discharge of the employer’s data processing tasks arising in the process of selection and establishment of the employment relationship, during the employment practices, upon the termination of the employment relationship, and in connection with the departure of the employee from the organisation; we can also provide assistance in identifying the data processing processes that the employer should establish in the context of the above, including the procedure of document management and the definition of the retention period of the documents.
Különös tapasztalattal rendelkezünk a munkaerő-közvetítés és munkaerő-kölcsönzés területén. Munkatársaink az Opus Legal Kovács M. Szabolcs Ügyvédi Irodával együttműködve több hazai, illetve külföldi tulajdonú személyzeti szolgáltatónál láttak és látnak el adatkezelési támogatási feladatokat, vettek részt auditokban és hatásvizsgálatok elkészítésében, illetve nyújtanak adatvédelmi tisztviselői (DPO) szolgáltatásokat. A HR szolgáltatók mellett autóipari beszállítóknak és a pénzügyi, illetve egészségügyi szektorban végzünk hasonló feladatokat.
